Terms of Service

1. General

These Terms of Service are governed and to be construed in accordance with the laws of England and Wales. If any term is held void or unenforceable in whole or part by any court or other competent authority, the remaining terms and the remainder of the terms affected, shall remain in full force and effect.
2. Employment Status
Dave Cox operates as a self – employed, sole trader, therefore in accordance with employment law, he is not to be supervised (Dave Cox fully appreciates care staff will be present when he supplies his services), directed or controlled by any parties. Dave Cox may arrange for a suitable substitution to supply the music service.
3. The Music Service
The core music services provided by Dave Cox are:

  • Live singing to recorded backing music
  • Live singing with guitar playing

4. Payment

Payment will be made in cash on the day the music service is supplied or by bank transfer within 30 days of the music service having been supplied. Dave Cox will issue an invoice for the total fee charged.
5. Cancellation & Re-scheduling
a. In the event of the Booking Party needing to cancel or re-schedule a music service, 24hrs notice is required prior to the start time, otherwise full payment will be due.
b. In the event of Dave Cox needing to cancel or re-schedule a music service, as much notice as possible will be provided. Dave Cox cannot offer any compensation as he will lose income when he has to cancel.
6. Health & Safety
Dave Cox will abide by all health and safety measures he is made aware of that are in place at the premise. All electrical equipment used by Dave Cox will either be run on battery power or be used with a circuit breaker.
7. DBS
Dave Cox has a valid enhanced DBS check and is registered with the online update service.
8. Complaints
If ever any complaints arise, all concerned parties will be asked to give their account and all parties will be treated respectfully and fairly.
9. Liability & Insurance
Dave Cox holds Public Liability Insurance to the amount of £1million. Dave Cox cannot be held liable for any injuries or damages to any persons unless directly caused by his negligence and only when an independent & competent, investigatory body rules he has been negligent.
10. Force Majeure Event
If a “Force Majeure Event” was to occur that prevents any party from full-filling their obligations under these terms, no fees of any type will apply.
11. Amendment of these Terms of Business
Dave Cox reserves the right to amend these Terms of Service.
